The Basics of a Web Site Design Contract
![]() |
A web site design contract is an agreement between a professional and their client which spells out all the details and obligations of both parties. A contract is an important thing to have because it protects both the person or company providing the service as well as the customer. In this article you will learn more about the various parts of a contract between a web designer and their client.
The first part is normally something called Authorization. This section specifies the name of the company and customer, as well as the basic services that are to be provided. It also specifies the rights that the designer will have as far as access to the site or any particular accounts are concerned. In this part of the contract, whether or not the developer will be submitting the site to search engines or not will be documented as well. The next section will deal with development. This has a lot to do with the specification of compatible web browsers. Then, there may be a section that states the company can and will use subcontractors if they deem it necessary for timely project completion.
Then, you're likely to find information regarding trademarks and copyrights. After that, there may be a section which talks about site maintenance and the responsibilities of the design company. This section will specify the length of time that the design company will continue to maintain the website and whether or not said maintenance will be included in the initial cost or will cost extra. After that, there should be a part of the contract which talks about delivery time and when you can expect your site to be done.
The tail end of the web site design contract may contain a variety of aspects, with the most important being payment details. The payment section will specify how much the customer is required to pay and when they are required to pay it. It's likely there will also be information on the collection and/or litigation process if payment is not received as specified. If there is a deposit required, that will also be noted in this section. After that, there will be a closing statement to wrap up the contract, as well as places for both provider and customer to sign and date. A contract can sometimes be a wordy and confusing document. However, the right web development professional will be happy to explain every aspect of the contract so that you fully understand all requirements and information before signing.
